Terms of Service

Terms governing DCHosting managed technology services.

1. Services

DCHosting provides managed technology services, which may include application administration, configuration management, software maintenance, supported update assistance, backup and recovery management, API and integration assistance, monitoring and supporting infrastructure management. The exact scope of a service is determined by the selected plan, order, quote, invoice and any related written agreement.

2. Orders and Onboarding

Clients must provide accurate account, billing and onboarding information. DCHosting may request information or access reasonably necessary to deliver the service. Service delivery may be delayed when required information, approvals or access are not provided.

3. Fees and Billing

Fees are shown during ordering or stated in a written quote or invoice. Managed services may be billed monthly, quarterly, semi-annually, annually or on another agreed schedule. Clients are responsible for charges associated with services they order and authorize.

4. Renewals and Cancellation

Where a service is configured to renew, it will continue for successive service terms until cancelled according to the applicable billing arrangement. Clients should request cancellation before the next renewal date to prevent a future renewal. Additional details are provided in our Refund & Cancellation Policy.

5. Acceptable Use

Clients may not use DCHosting services for unlawful activity, unauthorized access, infringement of third-party rights, malicious software distribution, fraud, abuse of networks or systems, or activity that violates applicable law or a third-party provider's terms. DCHosting may suspend or terminate services when reasonably necessary to protect systems, comply with legal obligations or address material violations.

6. Client Systems and Third-Party Services

Many managed services depend on client-controlled systems or third-party software, networks, hosting platforms, APIs and service providers. DCHosting is not responsible for outages, changes, restrictions or failures caused solely by third parties or systems outside DCHosting's reasonable control.

7. Backups and Recovery

When backup or recovery management is included in a plan, DCHosting will perform the agreed service scope. Clients remain responsible for identifying critical data and should maintain appropriate independent backups unless a written agreement specifically assigns that responsibility to DCHosting.

8. Custom Development and Project Work

Custom development, migrations, specialized integrations and project work may be subject to separate quotes, milestones, specifications or written terms. Those project-specific terms take precedence where they conflict with these general terms.

9. Intellectual Property

Each party retains ownership of its pre-existing intellectual property. Clients represent that they have the rights and permissions necessary for materials, software, accounts and systems they ask DCHosting to access or manage. Ownership and licensing for custom development will be governed by the applicable quote or project agreement.

10. Confidentiality and Security

DCHosting will use reasonable measures to protect client information provided for service delivery. Clients must protect their account credentials and promptly notify DCHosting of suspected unauthorized access to their account.

11. Service Availability

DCHosting will use reasonable efforts to provide services as agreed, but uninterrupted or error-free operation cannot be guaranteed. Maintenance, third-party outages, network conditions and events outside reasonable control may affect availability.

12. Limitation of Service Scope

Services are limited to the selected plan and agreed work. Work outside that scope may require a plan change or separate quote. DCHosting does not provide legal, accounting or regulatory advice.

13. Changes to These Terms

DCHosting may update these terms from time to time. The current version will be published on this website.
